The database of intersection photographs (Data) is provided as is without warranty of any kind, express or implied, including but not limited to, warranties of performance, merchantability, fitness for a particular purpose, accuracy, omissions, completeness, currentness and delays. Customers exclusive remedy and StreetDeliverys entire liability if any, for any claim(s) for damages relating to the Data whether based in contract or negligence, shall be limited to the rate of normally charged by StreetDelivery for any individual intersection photograph. In no event shall StreetDelivery be liable to customer for any lost profits or other consequential, exemplary, incidental, indirect or special damages relating in whole or in part to customers inability or failure to access the Data, the accuracy, completeness, currentness of the Data, any omissions in the Data or any decision made or action taken by the customer in reliance upon the Data.
